Paths to U.S. Citizenship

Finding a clear path to citizenship is the primary goal of many undocumented immigrants. There are a few paths to citizenship that are available for undocumented individuals. However, eligibility for these paths depends on the status of the person in question. Possible paths to citizenship include:

Green Card Through Marriage

This method is traditionally viewed as the easiest way to obtain citizenship. However, the process isn’t as simple as it looks on television. This is particularly true if the undocumented spouse entered the country illegally. Additionally, the marriage must be legitimate and all previous marriages must be lawfully terminated. Marriage fraud can result in a felony criminal charges.

DREAMers Green Card Through Employment with Life Act Protection

In some cases, DREAMers who have attended higher education institutions can become candidates for skilled jobs. Employers can sponsor an undocumented employee for permanent residence. The LIFE Act allows undocumented immigrants to finish their green card process in the U.S. However, a petition for citizenship must have been filed prior to April 30, 2001.

Asylum Status

To qualify for asylum status, you must:

  • Be physically present in the US
  • Unable or unwilling to return home due to persecution or fear of persecution upon your return
  • Not be engage in activities that might bar you from asylum

The reason for persecution must be tied to your race, religion, nationality, membership in a particular social group, or political opinion.

U Visa for Victims of Crime

The Victims of Trafficking and Violence Prevention Act created what is known as the U visa. The act is intended to protect non-citizens who have been victims of certain crimes and those who have helped law enforcement. U visas not only provide legal status and employment authorization, but can also provide a path to permanent resident status in some situations.
