How to Change Your Immigration Court Hearing Location
Based on 8 C.F.R. § 1003.20(b) of the Code of Federal Regulations,
an immigration judge has the ability to change the venue of your case,
if you demonstrate good cause. According to certain factors which prove
relevance toward relocation, the Board of Immigration Appeals may grant
These factors include:
- Administrative convenience
- Location of witnesses
- Cost of transporting witnesses
- Expeditious treatment of your case
In order to properly request a change the location of your immigration
court hearing, you must file a Motion to Change Venue with the respective
court where your hearing is scheduled. By adhering to all of the requirements
in the Immigration Court Practice Manuel, providing valid reason for requesting
a change of venue, and filing the document on time (at least 15 days prior
to your scheduled court date), you are eligible to conduct such a motion.
